The OMB has issued a “stay” in a $600,000 defamation lawsuit by a developer against the Co-Chair of the Kingscross Ratepayers’ Association (KRA) of King Township. The hearing has been adjourned until the SLAPP suit is resolved. The SLAPP suit was filed four days before the Township’s statutory public meeting was to be held…just a coincidence? Mary Muter, Co-Chair of KRA and also Chair of the Georgian Bay Great Lakes Association, argued that the group was intimidated by the SLAPP suit. She is defending the defamation suit and has asked the court for a summary dismissal. In a recent letter to IDA, David Donnelly of Donnelly Law praised IDA, Campaign Lake Simcoe and Environmental Defence for strongly advocating for this special provision in the Protection of Public Participation Act, 2015 (“PPPA”), calling it “a victory for free speech and the environment”.
